The ScreenDiary mobile application and any associated services (collectively, the “App”) are made available to you by ScreenDiary (“we”, “us”, “our”). By accessing, using or downloading any materials from the App, you agree to follow and abide by these Terms of Use (“Terms”). We may update these Terms periodically without prior notice. The most recent version of the Terms can be viewed here at any time.

This App is not designed for children under 13 years of age. By using this App, you agree to the Terms and all revisions thereof. If you disagree with any part of the Terms, please do not use our App.

Modification of Services

We reserve the right to modify or discontinue, temporarily or permanently, the App or any features therein without prior notice. You agree that we shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the App.

Proprietary Rights

The App, including any necessary software used in connection with the App, contains proprietary and confidential information protected by applicable intellectual property laws. Except as expressly authorized by us, you agree not to modify, copy, distribute, or create derivative works based on the App, in whole or in part.

You are granted a personal, non-transferable, non-exclusive right to access and use the App, provided that you do not copy, modify, create a derivative work from, reverse engineer, or otherwise attempt to discover any source code.

ScreenDiary, the ScreenDiary logo, and other ScreenDiary logos and product and service names are trademarks of ScreenDiary. You may not use these trademarks without our prior written consent.

Disclaimer of Warranties and Liability

THE APP AND ITS CONTENT ARE PROVIDED “AS IS”, WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We make no warranty that the App will meet your requirements; that the App will be uninterrupted, timely, secure, or error-free; that the results obtained from the use of the App will be accurate or reliable; or that any errors in the App will be corrected.

YOU AGREE TO RELEASE US FROM ANY LIABILITY ARISING FROM YOUR USE OF THE APP. WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM YOUR USE OR INABILITY TO USE THE APP.

Indemnification

You agree to indemnify and hold us harmless from any claim or demand, including reasonable attorneys' fees, due to or arising out of your use of the App, your violation of these Terms, or your violation of any rights of another.

Termination

We may terminate your access to the App, without prior notice, under certain circumstances, including but not limited to your violation of these Terms. Termination may include barring you from future use of the App.

Applicable Laws

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located within Australia.

General

These Terms represent the entire agreement between you and us concerning your use of the App. If any provision of these Terms is deemed invalid, the remaining provisions will remain in full force and effect. You may not assign or transfer your rights under these Terms without our prior written consent. We reserve the right to assign our rights under these Terms to any third party.
